An LNC provides support on any case where health, illness or injury is the core or an important component of a legal matter. This can be an unbiased review or a review that includes strategies that can be utilized by either the plaintiff or the defense depending upon what the specific attorney needs.
An LNC will thoroughly review the medical records to decipher the information needed and translate this into a comprehensive summary for the attorney. This includes a medical chronology and fact summary for the attorney to gain a complete understanding as to what are their client’s pre-existing conditions, current injuries, and the consequences of the accident to help with determining causation of damages. This comprehensive report includes images and illustrations to give the attorney an understanding of what exactly the medical diagnoses are. This report can include the LNC’s clinical opinion, recommendations, and any “red flags” noted within the client’s medical records. These “red flags” can be identified and addressed early in the case if necessary. By having these reports and continued support by an LNC, an attorney will have the injuries, possible liability points, potential arguments, and evidence at his/her fingertips, making an early settlement more feasible.
By bringing in an LNC, the attorney saves time so that he/she can utilize their skills to work on the legal aspects of their case and provide more time to their client.
Paralegals and attorneys are BUSY! Whether it's meeting with clients, taking calls, completing research, attending court, reviewing documents, etc., their time is stretched thin. This is where an LNC can be utilized to reduce the time spent on and enhance the medical review aspects of a case. They save the attorney and their client money, while also giving the attorney and paralegals their time back to focus on the legal parts of a case.
An LNC brings his/her experience and knowledge to recognize, interpret and analyze all relevant medically related information in a claim or case. Unbeknownst to the attorney or the paralegal, he/she may include unnecessary information (wasting time and money) or miss information that could be what enhances a case (helps increase a case settlement). An LNC is familiar with patient charting and can recognize errors or omissions.
Additionally, an LNC can complete a more in depth review of medical malpractice cases for merit to identify a strong or weak case prior to the attorney accepting the case. The LNC’s merit report will analyze all the available evidence to determine whether the health care professionals provided the standards of care or made a mistake. An LNC can also indicate if chart tampering has occurred in order to cover up mistakes.
